Fired without prior notice — what are you owed?
In Israel an employer must give written prior notice before dismissal, and the notice period grows with seniority. If you were let go without it, you are generally entitled to payment in lieu of notice, plus any severance and benefits you accrued.
Prior notice and pay in lieu
The notice period depends on your seniority and on whether you were paid monthly or hourly, so check your own case against the table on Kol Zchut rather than assuming a round number. Skip the notice and the employer generally owes your regular pay for that period instead. Two details set the amount: your exact last working day, and what counts as regular wage, which usually includes fixed additions and not only the base line.
Severance and final balances
Notice is one component. Check separately for severance, redemption of unused vacation, convalescence pay, and pension amounts withheld but never deposited. Ask for a final payslip and a 161 form, which is what releases your pension and severance funds.
Was the process lawful?
How a dismissal is done matters as much as whether it was allowed. A hearing is often required first, with the reasons given and a real chance to respond. A decision made in advance, or announced by message with no hearing, can strengthen a claim more than the unpaid notice itself. Note the date, who was present, and whether the reasons were put in writing.
FAQ
- Can I be fired by WhatsApp or verbally?
- Dismissal should be in writing and, in many cases, only after a hearing. A flawed process strengthens your claim, so keep every message.
- How long do I have to act?
- Money claims have limitation periods and evidence gets harder to retrieve. Gather your payslips and contract early, even if you have not decided whether to file.
- Does notice pay depend on why I was fired?
- Usually not. It follows from the missing notice itself, whatever the reason, with narrow exceptions in serious disciplinary cases.
- My employer says I resigned. What now?
- That changes both notice and severance, so it matters. Find anything in writing showing who ended the relationship, and never sign a resignation letter you did not intend to write.
