A debt enforcement file was opened against you: what happens now

An enforcement file is not a court judgment against you in every case, and the difference matters. Some files start from a judgment, others from a document such as a cheque or a promissory note, and those can be objected to. Either way the window for responding is short and it starts when the warning reaches you.

Find out what the file is based on

Ask for or look up the file's basis before doing anything else. A file opened on a judgment is enforcing a decision already made, so the argument is about payment rather than liability. A file opened on a document is different, and there is a defined period in which you can object and have the matter examined. People miss this because the warning looks the same in both cases and reads as final in both cases.

Do not ignore it, even if it is wrong

Ignoring a file does not pause it. Restrictions can follow, including on bank accounts, licences and leaving the country, and they are considerably harder to remove than to prevent. If the debt is not yours, or has already been paid, say so through the proper route with the evidence rather than by telephone. Keep proof of every payment you have ever made towards it, because in enforcement the burden of showing payment tends to land on you.

Payment arrangements and the ability to pay

Where the debt is real, an arrangement based on what you can actually pay is usually available, and there are routes for debtors of limited means. An arrangement you can keep is worth more than one that collapses in two months and leaves you worse placed. Prepare your income and expense picture properly before proposing anything, and get any agreement recorded in the file rather than agreed with a collector.
